solution planners “can support”, while locking out objections and withholding or delaying
disclosures that should be made
15. I apologise for what might appear to be rant, but it is important that everyone
understands the intensity of feelings generated by this case and residents’ determination to
seek a fair and compliant resolution.
C CLARFIFYING IMPORTANT PRINCIPLES
This part is my attempt to unravel the myriad of planning principles, to provide an audit trail
obtain confirmation from professionals as the basis of narrative for legal---- expert witness…..
NPPF update July 2018
1. I have analysed thousands of pages of planning document but, as a layman, struggle to
find precision and certainty. It seems that for every policy, process, rule or guideline in
one direction an alternative in opposition can be contrived. Some planners and
developers– like Humpty Dumpty – use words, abbreviations (which are not always
defined) and technical terms interchangeably and inconsistently to suit the circumstances.
2. My conclusions on errors in and unlawfulness of the AWNP rely on the following.----
audit trail---
3. The Localisation Act 2016 supposedly devolves powers to neighbourhood and local
representative. In fact, power is retained at a District or County level. Parking ASW and
xx calculators offsets—what’s in the applications
4. AWVC regards village—colour plan—4 sectors---
5. CIL potentially perverse financial incentives--- consultation--- village office… and others of
no benefit to residents in the Lewes Road
6. The overarching aim of the National Planning Policy Framework (NPPF) is to require
sustainable development, spatially xxxxxxx be “plan led” undefined so that the right
homes are built in the right places; no obligation – in fact----
• Plan led means
• Spatially xxx means
7. As the “made” plan for Ashurst Wood the Neighbourhood Plan (AWNP) is authoritative
(if not definitive):
• There is a presumption in favour of sustainable developments included within it
providing they were available, properly assessed, viable, deliverable and comply with
environmental, design and other principles.
• Inclusion of a site in the AWNP does not automatically guarantee that approval will
be given;
• “Potential housing capacity” (also referred to as “anticipated housing capacity” or
“indicative numbers of dwellings”) is not inviolable and can be increased or reduced,
depending on design and compatibility with the xxxxxx. However… no massive
variation Given that Sustainability Appraisals were compiled with care, in strict Page 5
