This is its present status: The National Human Rights
Commission of South Korea (NHRCK) is the independent
commission for protecting, advocating, and promoting human
rights. This commission, by law, is guaranteed an independent
status regarding all human rights issues in South Korea.
According to the judgment of the Constitutional Court of
Korea in 2010, NHRCK is an independent agency inside the
executive branch of the South Korean government. It is under
constant review and progress can be expected as human rights
becomes an important focus for the agenda of the current
South Korean government, which is dedicated to helping
solve these problems.
An eventual three-tiered approach to justice and accountability
for North Korean crimes can address the massive injustices. If
domestic prosecution in South Korea has not yet occurred, a
hybrid tribunal (partially domestic and partially international)
can try those most responsible for the most heinous crimes.
A Truth and Reconciliation Commission could handle those
least culpable. Domestic prosecution could handle everything
in between.
For its massive violations of human rights as well as the
security risks that it poses, North Korea should be ousted
from the United Nations. No country committing such mass
atrocity crimes should be allowed to remain in the UN. North
Korea’s aims run counter to the UN’s major purpose of peace.
The U.S. government should make mass atrocity
determinations for North Korea in every category of mass
atrocity: genocide, crimes against humanity, and war crimes.
