around her neck. The victim then stated the defendant shook her and gave her whiplash, and she began hyperventilating
when she could not breath.
The photographs showed indications of a healing injury above the right eye, and some healing marks on her neck, which
were undetermined and not showing large patterns of redness or abrasions, with indications of healing consistent with
over 2-3 days. There were two areas on the victim’s right lateral neck consistent with a ‘hickey’. The victim also stated
her hands were free during the choking incident, and her legs – she kicked, punched and screamed. The defendant had
no injuries to his face, arms or hands, and did not complain of pain or soreness. Police records reviewed showed this was
the third 911 call in a week by the victim and reporting the defendant had choked her after an argument. Review of the
physical examination further noted the physician found indications of fresh IV drug use on both arms.
The reviewed evidence showed several inconsistencies, including unfounded statements and other facts not mentioned,
by both the victim and defendant. Both had extensive law enforcement contact and arrest histories, including for
domestic violence.
