b) The specific offense(s) committed or provision(s) of these rules violated;
c) Statements or declarations of witnesses, preferably taken under oath;
d) Findings of facts;
e) Recommendations for disciplinary action;
f) Supporting documents/physical evidence
9.7 Upon endorsement by the Department Head of the IFR, the same shall be submitted to
HRDMO along with copies of all documentations regarding the investigation and
recommendation. HRDMO may then recommend referral of the case to the Fact Finding
Committee (FFC) should the same be necessary.
9.7.1 Referral to the FFC shall not be necessary when:
a. The employee being charged has admitted to all the charges;
b. When the facts of the case can clearly be established through all the
documents and evidence the School has at hand; or
c. The surrounding circumstances of the case render referral to be impractical,
improper or prejudicial to the School’s interest.
9.7.2 Further, with regard to the composition of the FFC, the following rules shall
apply:
a. Members of the FFC must not have reporting relationships with the
employee subject of the investigation;
b. The FFC shall be composed of a minimum of three (3) members; and
c. Officers holding the positions of Department Head or higher may be
appointed members of the FFC.
9.7.3 The fact finding and investigative procedure shall adhere faithfully to the
requirements of due process while also recognizing that technicalities of law do not
strictly apply. Substantial evidence shall be sufficient to establish the facts of each case,
upon which decision of guilt or innocence will be based. On the other hand, the FFC may
utilize all necessary means to establish the facts of each case. Ocular inspection and
physical examination, among others, may be conducted.
9.7.4 During the last deliberation session of the FFC, the EVP or his representative may
be present to witness the rest of the proceedings.
9.7.5 Once the FFC finalizes its recommendation, the same shall be presented to the
President for his comments and/or approval. Upon approval, the recommendation
becomes the decision of Management with regard to the case and shall be discussed with
the Department Head, who in turn will forward it to the Department Head for
implementation.
Section 10 ENFORCEMENT AND PROCEDURES
General Provisions
➢ Where a single act can be classified into two or more offenses under these Rules, the
penalty for the more/most serious offense shall be imposed.
➢ The School reserves the right to alter, modify, and/or change the procedures
outlined above or any or all parts of these rules as the exigencies of business
warrant.
