Case #1: AirSoft Game
Causation: Breaches in safety protocol and procedures
It is important to note that the victim had no duty to be knowledgable of the safety protocol for force-on-
force training. He was reliant on the training event host to provide a safe environment and a qualified staff.
This was not an informal backyard event. He paid for admission to what was represented as a
professionally organized event.
• On this date, and at this event, there were no professionally trained instructors or safety personnel. In
place of trained staff, “referees” were used only to monitor the participants for cheating.
• The victim was permitted to participate using sub standard safety equipment and / or personal protective
equipment, and without using the industry standard mandatory full head, face and groin protection
specifically designed for use in force-on-force training.

• On the day of this incident there were no safety procedures in place to prevent anything live or lethal
from being intentionally or accidentally introduced into the training environment.
• None of the participants, including the victim were subjected to any safety pat downs and/or
professional searches to ensure that the training environment was sterile.
• Prior to the event beginning, the actual training area was never swept or searched for anything live or
lethal that could compromise the safety of the participants.
• The victim was told by a referee that if he saw any loose ammunition, other than air soft ammunition on
the ground to just leave it be, as it was probably left behind from a law enforcement agencies prior
training activity.
