Importance of legal compliances in respect of HSE for continuing business
While workplace injuries and accidents in itself are definitely bad for the moral of the workers
and other employees, Government have also enacted laws to ensure organisations take pre-emptive
actions to prevent harmful and hazardous situation at workplace.
- In Indian context, In accordance with the Factories Act 1948 for factories and BOCW act 1996 for construction
industries an occupier of an establishment or employers has to ensure the health, safety and welfare of all
the workers while they are at work in the factory. The factories act is further supported by various labour laws
specifically relating to health, safety and working conditions .Various provisions of this act and laws require
certain actions to be taken by the occupier / Employers and also defines penalties and imprisonment in case
of default
- In case of severe / repeated defaults labour inspectors are entitled to stop work . Any such stoppage is
bound to effect the productivity , time loss as well as reputation of the organisation thus effecting the
viability of organisation on long term basis.
- Further currently
The Occupational Safety, Health and Working Conditions Code (OSH) bill, is approved by cabinet and
released for public comment. It may get published after the public comments and subsequent update if any.
