report any pre-existing damage to the Company’s representative who travels
with you and staff of the accommodation, transportation service, or facility as
soon as possible upon discovery thereof.

e. You agree to take all necessary measures in relation to your own safety while on
tour and performance of the services including, but not limited to, the proper use
of safety devices (including seatbelts, harnesses, floatation devices, helmets, etc)
and obey all posted signs and oral / written warnings regarding health and
safety. Neither the Company nor its third-party suppliers are liable for losses or
damages whatsoever caused by your failure to comply with safety instructions
or warnings.

10. ACTING AS AGENTS ONLY
We act only as an agent for tour, services, carriers, transportation companies, hotels,
and other suppliers, and will not be responsible in any way, howsoever, for any losses,
damages, accidents, changes in the schedule, or other irregularities caused or arising
from circumstances beyond our control. We shall have no liability for any death,
personal injury, or loss of any nature that you may suffer.

11. COMPLAINTS
a. The Company will not be responsible for the non-performance of an itinerary,
tour, or services due to causes beyond its control or when the Company is not
notified of a problem at the point where remedial action can be taken. However,
if you encounter any issues during the tour, please inform the Company
representative.

b. All information given by the Company, whether in writing or orally, is to the best
of the Company’s knowledge and believed to be correct at the time given and it
is given in good faith. This T&C shall take precedence over any other warranty
or condition that may have been given to you.

12. IMAGES AND MARKETING
You hereby consent that, while participating in any tour with DXN or any services,
images, photos, or videos that are taken by other participants, DXN, or its representa-
tives may contain or feature you. You grant a perpetual, royalty-free, worldwide, ir-
revocable license to DXN, its contractors, subcontractors, and assigns, to reproduce
such images, photos, or videos for any purpose whatsoever, including marketing, pro-
motions, and the creation of promotional materials, in any medium whatsoever,
whether currently known or hereinafter devised, without any further obligation or
compensation payable to you.

13. PRIVACY POLICY
DXN will collect, use and disclose only the information required to enable the com-
pany and its third-party suppliers to provide the particular tour, products, and/or ser-
vices that you have requested. By providing your personal information to DXN, you
indicate your acceptance of the DXN Privacy Policy.
