Cases of alleged discrimination in violation of

                                                                                 federal or state statutes can be made under one

                                                                                 of two theories:

                           Proving                                                     1.      Disparate Treatment




                  Employment                                                                         When an employer treats an employee of a
                                                                                                      protected class differently from a nonprotected

                                                                                                      class employee in a similar situation
               Discrimination                                                          2.      Disparate Impact





                                                                                                     When an employer’s policy or practice, neutral
                                                                                                      on its face and in its application, has a negative
                                                                                                      effect on the employment opportunities of
                                                                                                      protected-class individuals.
