McCarran-Ferguson Reform
• Competitive Health Insurance Reform Act (H.R.1418), signed into law
1/13/21
• Repealed the provision within the McCarran-Ferguson Act that
exempts the health insurance industry from federal antitrust laws
• Decades-long effort by dentistry to get the bill enacted
• Federal agencies, like the Federal Trade Commission (FTC) and U.S.
Department of Justice (DOJ), are now empowered to enforce the full
range of federal antitrust laws against health insurance companies
engaged in anticompetitive conduct.
• In July, Sens. Leahy (D-VT) and Daines (R-MT) formally requested
updates from the DOJ and FTC on “any enforcement actions,
guidelines, rulemaking, or other actions taken to extend antitrust
enforcement to the health insurance industry.”
