Management), to provide notice of the intention to take a medical or family leave at least 30 days prior
               to the date the leave is expected to commence, or, if such notice is not possible, as soon as notice is
               practicable. York administers the Family Medical Leave Act for APUS employees. Employees can contact
               York 24 hours per day, 7 days a week at 1-888-436-9530. An Absence Specialist will assist through the
               process  and  provide  the  employee  with  documentation  including  the  Certification  of  Health  Care
               Provider form. This form must be completed  by  the  health  care  provider  and  returned  to  the  York
               Absence  Specialist  for review.

               Employees  must  submit  the  certification  documentation  to  the  Absence  Specialist  at  York  within  15
               calendar days or leave may be denied. York, in some instances, may require a second and third opinion
               (at  the  company’s  expense).  HR  can  request  recertification  documentation  every  30  days  if  deemed
               necessary.  When utilizing FMLA protected time, the employee should report missed time before their
               expected shift start while following their department’s policies for reporting absences.  When reporting
               an absence, the missed time must be designated as FMLA to the supervisor, in addition to reporting the
               absence to York. The report to York must be completed within 24 hours of the absence occurring, and
               must include the date of absence and length of time absent. If an employee fails to report their FMLA
               absence  in  a  timely  manner  to  York,  the  absence  may  be  considered  unprotected  time.  Unless  the
               employee is utilizing short-term disability, s/he is required to exhaust any accrued sick and vacation time
               while on leave.

               while on leave, with the exception of 40 hours of sick time which may be kept as a “reserve” for the
               employee’s  use  upon  return  from  leave  if  they  choose  to  elect  this  option.    Once  the  sick  leave  is
               exhausted, employees are required to utilize any accrued vacation time.

               While  out  on  disability  and/or  FML leave,  employees  are  responsible  for  their  portion  of  all
               benefit premiums. Employees must pay their portion of the premiums within 30 days of the due date;
               otherwise benefits coverage may be terminated.

               An  employee  returning  from  leave  for  his  or  her  own  illness  will  be  required  to  provide  medical
               certification  to  the  Absence  Management  Specialist  at  York  of  his  or  her  ability  to return to work
               before permitted to resume working.  To the extent the absence qualifies as leave under federal, state,
               or  local  law,  APUS will  comply with  all  applicable  federal,  state,  and  local  laws  with  regards  to  such
               leave.

               Eligibility for Paid Holidays
               All  regular,  nonexempt  and  exempt,  full-time  employees  will  receive  holiday  pay  on  APUS  observed
               holidays, at their regular rate of pay. There is no eligibility waiting period required after the hire date.
