P. 27

You may also, with your supervisor’s approval, use any available paid leave benefits, such as PTO, for
additional time off as necessary. The specifics for each bereavement situation will be handled on a case
               by case basis.

Bereavement pay is calculated based on the base pay rate at the time of absence and will not include
any special forms of compensation, such as incentives, commissions, bonuses, or shift differentials.

MTR defines "immediate family" as the employee's spouse/domestic partner, parent, child, sibling,
grandparent or grandchild; the employee's spouse's/domestic partner's parent, child, or sibling; the
employee's child's spouse, grandparent or grandchild.

                                                 Jury Duty/Court Appearance

MTR encourages you to fulfill your civic responsibilities by serving jury duty or witness duty when
required. Regular full-time and regular part-time employees are eligible for up to two weeks of paid jury
duty leave over any 2 year period, to a maximum of 10 working days. MTR will pay employee at current
rate of pay less the amount paid directly for jury duty compensation by the court. Employees may use
other available paid time off (e.g.: PTO) to supplement compensation by the court.

If you receive a jury duty summons, show it to your supervisor as soon as possible so that arrangements
can be made to accommodate your possible absence from work. You are expected to report for work
               whenever the court schedule permits.

Either MTR or the employee may request an excuse from jury duty if, in MTR judgment, the employee's
absence would create serious operational difficulties.

Subject to the terms, conditions, and limitations of the applicable plans, MTR will continue to provide
health insurance benefits for a maximum period of thirty calendar days after the unpaid jury duty leave
begins. At that time, employees will become responsible for the full costs of these benefits if they wish
coverage to continue. When the employee returns from jury duty, benefits will again be provided by
MTR according to the applicable plans.

These same rules and policies will apply if you receive a subpoena to testify as a witness in court.

PTO will continue to accrue during unpaid jury duty or witness duty leave. Employees who are called for
jury duty or witness duty can participate without fear of penalty.
