Safety Memo #13 Competent vs. Qualified Persons

[Competent Vs Qualified Persons]
According to OSHA’s Multi-Employer Worksite Policy, ACI is defined as a “Controlling Employer”. Per our role on the
construction jobsite, it is our duty as General Contractor to correct the hazards as quickly as possible.
Please find the attached PDF which lists items requiring competent persons versus items requiring qualified person and it can be
a useful tool in the field in recognizing activities that require a competent person to be either present or inspecting activities.
Many items in the construction field require competent people as well as qualified. Knowing the difference between the two
terms will help clarify who is required. Each jobsite must print and post the attached in a conspicuous location.
Please note the differences of classification: “Competent vs Qualified Persons”
29 CFR 1926.32(f) states: "Competent person" means on who is capable of identifying existing and predictable hazards in the
surroundings or working conditions, which are unsanitary, hazardous, or dangerous to employees, and who has authorization to
take prompt corrective measures to eliminate them.
29 CFR 1926.32(l) states: "Qualified" means one who, by possession of a recognized degree, certificate, or professional
standing, or who by extensive knowledge, training and experience, has successfully demonstrated his ability to solve or resolve
problems relating to the subject matter, the work, or the project.
Items that require qualification include, but not limited to:
• Crane Operator and Signal Person
• Rigging
• Heavy Equipment Operator
• Confined Space Person
• First Aid/CPR
• Fall Protection (Horizontal Life Lines)
• Electrical work (When applicable)
