Derivative misconduct has been
established where an employer does
not prove that the employees knew
the identities of the perpetrators but
an inference is to be drawn that such
employees were present during the
direct misconduct and, through their
silence, have committed derivative
misconduct on the basis of the breach of
trust between them and their employer.
