Abstract

Privatization in the broad meaning is “Increasing the contribution of the private sector in
the economic sectors, service and productivity. It is one of the tools to reduce Rationalizing
Government Spending, to promote the efficiency of the national economy and transforming
the economic role of state from mere "Service Provider" to "Regulator and Observer". Like
other policies, Privatization requires a number of administrative, technical, social and legal
factors to maintain success.
Through study and research, Researcher was able to determine the most important
Legislative and legal transformation requirements for Privatization Programs. Some of
these requirements had done previously by Saudi Arabia Government and the others must
be completed to ensure the effectiveness of economic reform programs and to achieve the
desired goal.
The researcher used the inductive - analytical method in addressing the study and he
divided the research into two sections, the first had the nature of privatization, its
importance and its legal frame. The second section had legislative and legal transformation
requirements for Privatization.
The objective of this paper is to provide guidance to policy makers in addressing legal
issues likely to arise once a governmental decision has been made to proceed with a
program for the privatization. And create an attractive and effective legislative
environment for implementing such programs within Saudi Arabia.
