Agreement Between
VILLAS AT SAVONA HOA
and
JWC CONSTRUCTION, INC.
d.b.a. JON WAYNE CONSTRUCTION AND CONSULTING
for
CONSTRUCTION MANAGEMENT
In an “At Risk” Format
FOREWORD
A. This Agreement was drafted this 26th day of June, 2015, and requires signature by both parties to
become effective. The effective date shall be the signature date of the last party to sign the
Agreement.
B. This Agreement is between VILLAS AT SAVONA HOA referred to in this Agreement as
"ASSOCIATION", and JWC CONSTRUCTION, INC., d.b.a. JON WAYNE CONSTRUCTION
AND CONSULTING referred to in the Agreement as “AT RISK” Construction Manager hereafter
“ARCM”.
C. The Project is VILLAS AT SAVONA HOA located at 955 E Knox Rd, Chandler, AZ 85225and
consists of Fourteen (14) Resident Buildings / Eighty Four (84) Units, and (1) Pool house.
D. The ARCM’S scope of services is generally described as the planning, design and performance of
construction defect mitigation and reconstruction Work to the extent and degree approved by the
ASSOCIATION and within the confines of an ASSOCIATION approved total Project budget. The
specific Statement of Work comprising the scope of services is as indicated in Article 1 of this
Agreement.
E. Execution of this Agreement authorizes the ARCM to proceed with PHASE ONE only as described
below. Authorization to proceed with subsequent phases shall be at the ASSOCIATION’S discretion.
F. The ARCM’S scope of services will be performed in an At Risk format whereby all planning, design
and defect mitigation Work will be performed by the ARCM, with all appropriate consultants, design
professionals, trade subcontractors and any other required persons or entities being under direct
contract with, and the responsibility of, the ARCM.
