                                    ATURA Opponents Seek InjunctionIn upcoming weeks, local residents who have filed a lawsuit against the United States government to block federal funding of the proposed Fort Greene Atlantic Terminal project, will seek a preliminary injunction to invalidate the $10.7 million Urban Development Action Grant approved by the U.S. Department of Housing and Urban Development (HUD) for the mixed use office, retail and residential development.%u201cWe are planning to file a motion for a preliminary injunction, to expedite the whole process,%u201d says South Brooklyn Legal Services attorney Raun Rasmussen, who filed the suit in U.S. District Court for the Southern District on Oct. 9. %u201cWe are alleging that HUD%u2019s approval of the grant is affirmatively harming the plaintiffs now by allowing the project to go ahead. Just in anticipation of the project people are constructing luxury housing that is displacing residents,%u201d he explained.The suit filed by the residents directs the Secretary of HUD, Samuel Pierce Jr., to withdraw HUD%u2019s approval of the UDAGmoney New York City received for the project being developed by Rose Associates. The plaintiffs say that HUD%u2019s unconditional approval of the UDAG v io la t e s T i t l e ft o f t h eFederal Fair Housing Act because the Rose pian would result in secondary displacement and hence segregation in an area that is now racially mixed. Rose has repeatedly stated that the project cannot be built without the %u25a0 UDAG money.Rose%u2019s plan, which received Board of Estimate approval on Oct. 9, calls for the creation of 643 condominiums targeted for families earning between $25,000 and $48,000, 215,000 sq. ft. of retail space and two 24-story office towers as well as a 10-screen movie theater.Rasmussen says a suit will also be filed in State court on the charges that the project%u2019s final environmental impact statement violates the State Environmental Quality Review Act by not adequately addressing the problem of secondary displacement and offering no mitigation measures for the problem. %u2014 Liz KochLandmarks Meeting Will Discuss Local BuildingsThe Landmarks Preservation Com m is s ionwill hold a Certificate of Appropriateness hearing Oct. 28 and will take testimony on construction projects on five downtown area properties. Hearings begin at 9:30am at the commission%u2019s Manhattan headquarters, 20 Vesey St.The owners of 300 Clinton St. in Cobble Hill are applying to demolish the exterior brick wall of a Greek Revival row house built in 1840 and rebuild it, and complete a gut rehabilitation of the interior. A three-story over the basement row house built in 1849 at 208 Kane St. in Cobble Hill needs new windows and the owners are asking to replace the current ones with one-on-one aluminum.In Ft. Greene, the owners of an Italianate row house with Greek revival details built in the early 1850%u2019s at 282 Carlton Ave. want to install new cornices, windows, doors and ironwork, restore the brownstone and brickwork, and legalize the rear facade and interior alterations.Two projects in Park Slope on 2nd St. are also on the agenda.
