• Governance and Legal is not “front and centre” in the minds of CA’s like it should be.

• Two main and current issues include the Child Protection issue and the Data Protection Issue.

• The Child Protection issue is a critical issue on us currently, due to:

a) It being recognised as a key issue that we have a moral and legal obligation to address it.

b) It is becoming an issue that is increasing in the eyes of authorities due to the findings of the recent
Royal Commission enquiry.

• The Data Protection issue is something that will impact us increasingly due to:

a) Federal Legislation being passed that requires any data breach to be reported to The Australian Infor-
mation Commissioner

b) In addition to this, in Europe on 25 May 2018 the General Data Protection Regulation (GDPR) will
come into effect, which will mean much greater enforcement of regulations relating to the sharing
and protection of Data.

GOVERNANCE AND LEGAL QUESTIONS AND ANSWERS

Q: Are insurance policies available / in place for directors of state boards - is this a local board responsi-
bility?

A: There is a national insurance agreement with JLT, however, a separate insurance policy is taken out state
by state. (Each School)
Q: With small schools is there a standardised / legal process of support across state boundaries?

A: The OneSchool Charter is a legal document that establishes the relationship of the schools with OneSchool
and with each other.
