Compensatory Rest
Rest Days
If you have on-call liability you are entitled to claim rest days. The rest day entitlement varies and will
either depend on your roster, or arising from a Labour Court Recommendation, is dependent on the
event that gives rise to the rest.
If you operate on a roster greater than 1:4 there is no entitlement to rest days due to the lesser time
demand. The entitlement for qualifying Consultants is set out in Appendix 3.
You are expected to take your rest days as near as possible as the event that gave rise to the rest. If
you are unable to take your rest days promptly, due to service demands, the rest days may be
accumulated.
Arising from service demands, you may accumulate rest for three months from the earliest date of
on-call liability. After three months you may choose to be remunerated at a daily rate of the position
you are in. You may choose to accumulate the days for a maximum of six months instead, at which
point you must avail of the days or forfeit them.
Experience suggests that many Consultants do not avail of their full rest day entitlement; we would
encourage you to make sure that you do.
Historic Rest Days
A Consultant with an entitlement to historic rest days under the 1997 contract retains this entitlement.
Non holder of this contract do not have an entitlement to claim historic rest days.

The deadline to apply for historic rest days was originally 31 December 2020. However, due to the
Pandemic this deadline has been extended until 31 December 2021.
