vehicle, forklift, equipment, machinery or power tools; repairing, maintaining or monitoring the
              performance or operation of any equipment, machinery or manufacturing process, the malfunction or
              disruption of which could result in injury or property damage.

              Employees who violate this policy may be subject to disciplinary action up to and including termination
              of employment. Kontoor recognizes that responsible consumption of alcohol (which is not excessive) is
              allowed at certain Company events and certain customer functions. If employees have questions about
              this policy, please discuss with the appropriate HR Business Partner or member of management.


              Kontoor may require an applicant/employee to undergo substance abuse testing, in accordance with
              applicable laws, under the following circumstances:


                  1. Drug testing after a conditional offer of employment has been made to an applicant;

                  2. Drug and/or alcohol testing when any member of management has a reasonable suspicion that
                     the employee may be under the influence of an illegal substance or impaired by a legal drug or
                     alcohol. Factors that may give rise to reasonable suspicion testing include, but are not limited
                     to, an employee's appearance, speech, smell, or behavior, a report of prohibited drug or alcohol
                     use, or any other information indicating that an employee possesses illegal drugs or is under the
                     influence of or impaired by drugs (illegal or legal) or alcohol;

                  3. Drug and/or alcohol testing after an employee causes, contributes to, or is involved in a work-
                     related accident, if any member of management has a reasonable suspicion that drug and/or
                     alcohol use contributed to the accident (examples of factors that may give rise to reasonable
                     suspicion are included above in number 2) or after an employee causes, contributes to, or is
                     involved in a work-related accident that (i)  resulted in a fatality, (ii) requires medical attention
                     beyond first aid or results in lost work time, or (iii) caused property damage (including damage
                     to vehicles owned or leased by Kontoor or being used for Kontoor purposes) in a significant
                     amount. Drug/alcohol testing under this section will be undertaken as soon as practicable after
                     the reported injury or accident, and administered to employees who Kontoor reasonably
                     believes may have contributed to the injury or accident; and/or

                  4. Drug testing based upon random selection. All employees subject to random testing will have
                     an equal probability of being neutrally selected for such testing regardless of whether the
                     individual has been previously selected or tested. The Company does not have the right to
                     waive the selection of any person who has been randomly chosen.

                  5. Employees must also comply with any drug and/or alcohol testing policies or rules, applicable to
                     their particular location. Certain employees may also be a subject to DOT, FAA, or other
                     applicable drug and alcohol testing requirements. Kontoor will comply with all such applicable
                     laws and regulations and will comply with state law requirements governing drug and/or alcohol
                     testing, which are not preempted by federal law.

              Any individual who refuses to submit to the test or has a positive test for illegal drugs or alcohol will be
              denied employment and/or terminated. Also, any individual who tries to avoid the test or to affect the
              results of the test by any trick or device, or who produces a specimen that is not adequate for testing,
              will also be denied employment or terminated. Prior to taking any adverse action, the applicant or
