Procedures
A. In all cases of individual rights violations, especially abuse, neglect, and exploitation, the individual’s family
and DBHDD/ DCH will be notified pursuant to procedures outlined in this policy and in the policies
regarding Incident Reporting.
B. All reports of witnessed and/or suspected rights violations will be thoroughly investigated. If a contractor
has been found to have violated an individual’s rights as defined in this policy, the case will be reviewed
for potential referral to the state entity. In every case where it is determined by a preponderance of the
evidence that a contractor has abused, neglected or exploited an individual, dismissal of that contractor
is mandatory.
C. All staff are required to protect individuals’ rights by reporting immediately every incident of witnessed
or suspected rights violations. Failure of any contractor to report alleged violations will result in
appropriate disciplinary action up to and including dismissal.
D. There will be no retaliation against a contractor who has reported suspected individual rights
violations.
Member responsibilities recognized by the provider include:
1. The responsibility to notify service provider(s) of any changes in care needs
2. The responsibility to treat provider staff in a courteous and respectful manner, as well as cooperate with and
respect the rights of the caregivers providing care
3. The responsibility to be as accurate as possible when providing information on health history and personal
care needs
4. The responsibility to participate actively in decisions regarding individual health care and service/care plan
5. The responsibility to comply with agreed-upon care plans
6. The responsibility to notify the member's physician, service provider(s), and/or caregiver of any change in
one's condition
7. The responsibility to maintain a safe home environment or to inform provider(s) of the presence of any
safety hazard in the home
8. The responsibility to be available to provider staff at times services are scheduled to be rendered
9. The responsibility to pay any cost share liability, if applicable
All CCS contractors will be familiar with, and adhere to, all aspects of CCS Policy.
Communication: All communications, verbal and written should always be addressed in person first language. ISPs
and person-centered planning documents should also always be written utilizing person first language. Each
individual will also receive a copy of their rights at least once a year.
Training: Internal and state trainings on Rights and Responsibilities will be provided on an ongoing basis. Internal
trainings will need to developed going forward.
11.5 Medication Management
In accordance with CCS Policy case managers are not direct care providers and will not administer or transport
medication for any individual.
Monthly, during regular contact, the case manager and the individual and/or significant supports will review
any medical issues such as medications, nutritional and/or physical management care of the individual. CCS
will ensure all case manager s are trained and educated in the issues of nutritional, physical management,
seizure, and medication offered by the Area Office.
