was born in Jackson Parish, Louisiana on August 28, 1854. JAMES W. FOY,
their third child, also was born in Jackson Parish, Louisiana in 1857.
The September 14, 1860, United States census records for Jackson Parish,
Louisiana on page 18, line 29, dwelling/family # 116 has the following
information about the FOYs:
B.F. FOY, age 30, male farmer, born in Georgia
MISSOURI, age 8, female, born in Louisiana
JOHN E., age 6, male, born in Louisiana
JAMES W., age 3, male, born in Louisiana
ROBERT H., age 33, male farmer, born in Georgia
Note that ELIZABETH, B.F. FOY’s wife, is not listed. No information has been
uncovered to indicate what happened to her but it is presumed she died
sometime prior to 1860 for less than a month after the September 1860 census,
BENJAMIN married a twenty two year old widow named MARY ELIZABETH
PAYNE (or PANE, or PAINE) JACKS in El Dorado, Union County, Arkansas.
They were married on October 4, 1860. MARY, on July 13, 1856, at age 17, had
earlier married JOHN S. JACKS in Hempstead County, Arkansas. JOHN
JACKS subsequently died leaving MARY with a daughter, EMILY VIRGINIA
JACKS ( JINNIE), who had been born in Arkansas on August 2, 1857.
A record of the marriage of BENJAMIN and MARY can be found in the Union
County, El Dorado, Arkansas court house in Book “B”, page 238. The record

was filed October 15 , 1860 by J.P. NEIL BRUI. This community is just across
the border from Louisiana.
A discrepancy regarding BENJAMIN’s age comes from this marriage certificate
and the 1860 U.S. Census , both of which lists his age as 30 years old. If he was
born in 1827, as claimed on his military records, he should be 33 years of age.
Also, in the 1870 U.S. Census records of Limestone County, Texas ten years later
his age is listed as 42 years of age.
BENJAMIN’s fourth child, his first by MARY, was WILLIAM FRANKLIN
FOY. He was born in El Dorado, Union County, Arkansas January 19, 1863.
