EMPLOYMENT OF RELATIVES
Jones-Hamilton Co. permits the employment of qualified relatives of employees as long
as such employment does not, in the opinion of Jones-Hamilton Co., create actual or
perceived conflicts of interest. For purposes of this Policy, a relative is a spouse, child
(including biological, foster, adopted, and step-children), parent, sibling, grandparent,
aunt, uncle, first cousin, corresponding in-law or step relatives, or any other individual
Jones-Hamilton Co. perceives to be related to the employee. A spouse, for purposes
of this Policy, means an employee having a legal marital relationship, as well as an
employee involved in a relationship, which in the Jones-Hamilton Co. judgment is
characterized by the permanence, duration, and stability typically, associated with
marriage. Jones-Hamilton Co. will exercise sound business judgment in the placement
of related employees in accordance with the following guidelines:
1. Relatives are permitted to work in the same division, provided that no employee
may hire, discipline, promote, or give any pay raise or benefit to any relative
without prior written approval by the President.
2. No relatives are permitted to work in the same department or in any other
positions in which Jones-Hamilton Co. believe an inherent conflict of interest
may exist.
3. Employees who marry while employed are treated in accordance with these
guidelines.
4. If in the opinion of Jones-Hamilton Co., a conflict or apparent conflict arises as a
result of the employment of relatives, one of the employees may be transferred
at the Jones-Hamilton Co. discretion at the earliest practicable time. If, after
exhaustion of all reasonable efforts, transferring one of the employees is not
practicable, Jones-Hamilton Co. may terminate or require the resignation of one
of the employees.
REDUCTION IN FORCE
Under some circumstances, Jones-Hamilton Co. may need to restructure or reduce its
workforce. If restructuring the Jones-Hamilton Co. operations or reducing the number
of employees becomes necessary, Jones-Hamilton Co. will attempt to provide advance
notice, if possible, to help prepare affected individuals. If possible, employees subject
to layoff will be informed of the nature of the layoff and the foreseeable duration of the
layoff, whether short-term or indefinite.
In determining which employees will be subject to layoff, Jones-Hamilton Co. will take
into account, among other things, operational requirements, the skill, productivity,
ability, and past performance of those involved, and also, when feasible, the
employee’s length of service.
