             return his insult only if done privately at the moment the insult was made.
             But to go and tell other people what happened is Lashon Hara even if it                  אנשיל םושמ וב היהי אלד וירבד דימעהל לכויש ןפואב
             is told to only one other person and most certainly if it is told to many                               .רוסא יכה ואלבו אשיב
             people.  (And if the Tosafot is discussing a situation where it happened
             that he was publicly insulted and word of that insult was generally spread
             throughout society, and therefore the Tosafot permits it to be disclosed in              אבב תצבוקמ הטישב ןכ םג יתאצמ תופסותה שוריפ ןיעכו
             front of three people, then even not in front of three people it also would              ןכ שריפש ןושארה ושוריפב ל"ז י"רה תוילע םשב ארתב
             be permitted to be disclosed.  Also, if they are addressing a situation where
             some future benefit could come from making those remarks, that he would                  םג והולת ,וריבח חכמ רבדל ומצע ןיבל וניב ןכו .*ש"יע
             not be further demeaned in the future, as in this circumstance it would be               וינפב רמול שייבתמ היה אלש ןפואב רבדמ םאד ,ל"זח ןכ
             permitted to disclose those remarks, then even if these remarks were not
             made in the presence of three people they would still be permitted because               וילע רבדמ ןיא םא אקוד הזו ,הליחתכל וליפא רתומ
             he had no intention to denigrate his fellow Jew but rather because there                 ושוריפו ורמואה ןושלב יולתה רמאמ קר רוטניק ירבד
             was some tangible benefit to be had (as will be explained further on in all

             In order that the careful reader not be astounded, I will bring a proof to               ,רוסיא םוש עמושה לע ןיא הז ןפואבד עמשנ אליממו
             this concept from an explicit gemara, that even in this regard it would be               לק ןושלב ורמוא אמתסמש םושמ אוה רתיהה םעטד ןויכ
             forbidden to make these remarks about a fellow Jew even in the presence
             of three people.  From this gemara, one will conclude that necessarily other             ,עומשל רתומד אליממ ןכ-םא וריבחל יאנג היהי אלש
             expressions of Lashon Hara, even if they were true would be forbidden to                 ראוביש ומכו ,רוסאד ערה ןושל תעימש םושמ הזב ןיאו
             be made even in front of three people.  This is the language of Gemara
             Moed Katan (16a) “Rava asked, what is the source (in the Torah) allowing                 ל"נה הז ןפואב אתלת יפאב ןכו .'ב ףיעס 'ו ללכב ןמקל
             a court to send its agent to summon someone to appear in court?  The                        .םיעמושה לע רוסיא םוש ןיא ןכ םג וינפבכ יוהד
             gemara  answers,  the  pasuk  says  (Bamidbar  16:12)…and  Moshe  sent  a
             court agent to summon Datan and Aviram the sons of Eliav.”  And where
             do you see (in the Torah) that Beit Din has the authority to summon a                    תמא אוהש עדוי וליפא ,ינווג לכב רוסא יאנג רבד לבא
             person to appear before them?  (Answer) The pasuk relates (Bamidbar                      םוש ןיא עמושהל םגד אליממ יאדובו ,וינפב הרמוא היהו
             16:16) “and Moshe told Korach, you and all of your allies….”  And where
             do you see that if the court’s agent was cursed and humiliated and  the                  אוהש ובלב רבדה טילחהל ןכש לכו ,עומשל וליפא רתיה
             agent reported back to the court what had happened, that his report would                אתלת יפאבד ןויכ וינפב יאנגה רמוא אוהד ףא ,תמא
             be exempt from Lashon Hara?  (Answer) As the pasuk says “even if you
             gouged out their eyes we will not come.”                                                 וינפבכ ןכ םג אוהד ףא ףכית חיכונש ומכ לבקל רוסא
                                                                                                      'ז ללכב ןמקל ןייעו( והל תיא אניד דחד וינפב ןידה אוהו
             This is Rashi’s commentary (citation beginning with “if the agent of the
             rabbis was humiliated and trivialized) meaning that this agent was cursed                     .)תוקזח תויאר המכ דוע הז-לע ה"יא איבנש

               	 Choshen	Mishpat	(4  :  )	Maran	Shulchan	Aruch	states	that	in	a	case	where
