ARTICLE TI.5 CONFLICT OF INTERESTS

[I.5.] The berreficiaries must take all rlecessary measures to prevent any situatior^t of conflict oJ

II.5.2 T'he beneficiafies must inform the Agency without delay of any situation constituting or likely
to lead to a conflict of interests. They must take irnrnediately all the necessary steps to rectify
this situation.
The Agency rnay verify that the measures taken are appropriate and may require additional
measufes to be taken by a specified deadline.
ARTICLE II.6 CONFIDENTIALITY

II.6.l During implementatiorr of tl'te aclion and for fir'e years alter the payment of the balance, the
parlies must treat with confidentiality any cottfidential inJbrmation and documents.
11.6.2 The pamies nray only use conJidential information and docuntenls for a reason other than to
fulfil their obligations under the Agreement if they have first obtained the prior written
agreement of the otlrer pafty.
II.6.3 The confidentiality obligations do not apply if:
(a) the disclosirrg patty agrees to release the other party frorn those obligations;
(b) the crtn/identiul injbrmatiott or docunrcnts become public through other means than a breach
of the confi dential ity obligations;
(c) the disclosure of the conJidential information or documents is required by law,
ARTICLE II.7 PROCESSING OF PERSONAL DATA

Il.7.l Processing of personal data by the Agency
Atty petsonal data included in the Agreernent must be processed by the Agency in accordance with
Regulation (EU) No 2018/1725.1
Such data must be processed by the data controller identif-red in Afticle I.7.1 solely for implementing,
managing attd monitoring tlre Agreement or to protect the financial interests of the EU, inclLlding
checks, audits and investigations in accordance with Article I1.27.

beneflciaries liave the light to access, rectify ol' erase their own pemonal data and the right to
restrict or, wlrere applicable, the right to data ponability or the right to object to data processing in
accordance with RegLrlation (EU) No 201811725. For this purpose, they rnust send any queries about
the pt'ocessing of their personal data to the data controller identified in Afticle 1.7.1.
The benet'iciaries may have recourse at any tirne to the European Data Protection Supervisor.
