                          T'he beneficiaries  must ensure  that the conditions applicabte  to them under Articles II.4, 11.5,
                          Il.6 and ll.9 are also applicable  to the conrractors.

                  II.l0.3 The beneliciaries  retnain solely  respousible  for carrying  out the ctction  and for compliance
                          with the Agreeme[t.

                  II.10.4 lf the beneficiaries  breach  theil obligations under Article ll.l0.l the costs related  to the
                          contract concerned  are considered ineligible in accordance  with Article  II.lg.2 (c). (d) and
                          (e).


                          lf the beneficiaries  breach  their obligations  under Article  II. 10.2 the grant may be reduced  in
                          accordauce with Article  11.25.4.

                  ARTICLE II.II    SUBCONTRACTING OF TASKS  F'ORMING  PART OF THE ACTION
                                -

                  II.11.1 Beneflciaries  may subcontract tasks forming part of the action. lf they do so, they rnust
                          ensure  that, in additio'to  the conditions  specified in Article ll.l0, the following conditions
                          are also cornplied  with:

                          (a) subcontracting  does not cover  core tasks ofthe action;

                          (b) recourse to subcontracting isjustified  because  ofthe nature of the action and what is
                              necessary  for its implementation;

                          (c) the estimated costs of the subcontracting  are clearly identifiable  in the estimated budget
                              set out in Annex lll:

                     (d) any recotll'se to subcontracting,  if not provided for in Annex l, is communicated  by the
                        coordinator and approved  by the Agency.  Tlie Agency may grant approval:

                              (i) before  any recoufse to subcontracting, if tlre beneficlaries request an amendment  as
                                  provided for in Article Il.l3; or
                              (ii) after  recoulse to subcontracting  ifthe subcorrtracting:
                                         is specifically justified in the interirr  or finaltechnical  report referred  to in
                                         Articles  1.4.3  and 1.4.4:  and
                                        does not entail  changes to the Agreement  which would call into question
                                        the decision  awarding  the grant or be contrary  to the equal  treatment of
                                        applicants;

                          (e) the beneficiaries  ensure  that the conditions applicable  to thenr under Article ll.8 are also
                              applicable  to the subcontractors.

                  II.11.2 If the beneflciaries breach their obligations  under Articte ll.l l.l (a), (b), (c) or (d), the costs
                        related to the contract concerned  are considered ineligible  in accordance  with Article ll.lg.z
                        (f).
                        If the beneficiaries breach  their obligation under Article ll.ll.l (e) the grant may be reduced
                        in accordance with Article  11.25.4.
                 ARTICLE TI.I2- FINANCIAL SUPPORT  TO THIRD PARTIES


                  II.12.1 lf, while implernentingtlte action, the beneficiaries  have to give financial  support to third
                          parties,  the beneficiaries must give such financial suppoft in accordance with the conditions
                          specified  in Annex L Under those conditions,  the followine infonnation  must be stated  at
                          least:
