(b) reqLriring it to present a request for amendment of the Agreernent as provided for in Article
Il' 16.3. This obligatiott does not apply if the Agreement or the participation of a beneficiary is
terminated itt accordance with Articles II.l7.l, ll.l7.2 or points (c), (g) or (h) of A(icle
il.1 7,3.1 .

II.l6.3 Effects of the suspension

If the impf ementation of the action can be resurned ard the Agreement has not been terminated, an
atnendment to the Agreement must be rnade in accordance with Article II.l3 iu order to:
(a) set the date on which the action is to be resumed:

(b) exterrd tlre duration of the action; and

(c) rnake other changes necessary to adapt the action to the new situation.

The suspension is lifted with effect from the resumption date set out in the amendment. This date rnay
be before the date on which the amendmetlt enters into force.

Costs incurred during the period of suspension that relate to the implementation of the suspended
ctctittn or the suspended part of it rnay not be reimbursed or covered by the grant.

SLrspending intplementation of the qctiort does not affect the Agency's right to terminate the
Agreement or to terminate the participation of a beneficiary in accordance with Article 11.17.3, reduce
the grant or t€cover amounts unduly paid in accordance with Articles 11.25.4 and 11.26.

Neither party may claim darnages due to suspension by the other party.

ARTICLE II.I7 TERMINATION OF THE AGREEMENT

1I.17.1 Termination of the Agreement by the coordinator

The benet'iciaries may tenninate the Agreernent.

The coordinator must send aJbrmal noliJication of terrnination to the Agency, stating:

(a) the reasons fbr termination; and
(b) the date on which the termination takes effect. This date must be set after the formal
notificatiort.

If the cooldinator does not state the reasons for tlre termination or if the Agency considers that the
reasorls do not justify termination, the Agreement is considered to have been tenninated irnproperly,

Tlre ternrination takes effect on the day specified intheJbrmal notification.

ll.l7.2 Termination of the participation of one or more beneficiaries by the coordinator

The participation of orle or more beneficiaries may be terminated by the coordinator at the request of
the beneficiary concerned or on behalfofthe other beneficiaries.
