                            (ii) in the case of point (c) of Article I1.17.3.1, to inform the Agency  of the measures  to
                               ensure cornpliance with tlre obligatiorrs  under  tlre Agreenrent.

                Step 2  -   If the Agency  does not receive observatiorrs  or decides to pulsue the procedure  despite the
                observations  it has received,-it  will send a,fbrnral notiftcati<tn to the coordinator infolrning  it of the
                termination and the date on which  it takes  effect.  The coordinator  must imrnediately  intbrrn  the other
                beneficiaries of the termination.
                Otfrerwise, the Agency must send a  .formal  nolificalion  to the coordinator  inforrning it that the
                termination procedure  is not continued.
                Tlte termination  takes effect:

                    (a) for tenninations under points (a), (b), (c) and (e) of Article lt.l7.3.l: orr the day specified  in
                       tlte  formal  notification  of terrnination referred to in the second subparagraplr  (i.e. in Step  2
                       above);

                    (b) fortenninations under points (d), (f) and points (g) to () of Article ll.l7.3.l: on the day atter
                       tlre coordinator  receives the  .formal  not  at.ion of termination  referred to in the second
                       subparagraph  (i.e. in Step 2 above).


                ll.l7.4 Effects of termination





                Within 60 calendar days from the day ou which the termination takes effect, the coordinator  must
                subrnit a request for payment  of the balance  as provided for in Article 1.4.4.

                If the Agency does rrot receive tlre request  for payrnent  of the balance by the above deadline, only
                costs or contributions which are included in an approved  technical  report and, where  rclevant,  in an
                approved financial statement, are reimbursed or covered  by the grant.

                lf the Agreement  is terminated  by the Agency because the cooldinator has breached  its obligation to
                subrnit the request for payment, the coordiuator  may not subrnit any request  fof payment  atter
                termination, In that case the second subparagraph  applies.

                The Agency  calculates  the final grant amount as referred  to in Afticle  11.25  and the balance as referred
                to in Article I.5.4 on the basis of the repofts submitted.  Only activities  undeftaken before the date
                wherr the termination  takes effect orthe end date of the implementation period  as specified in Article
                I.2.2, whichever is the earliest, must be taken into account.  Where the glznt takes the fornr of
                reimbursement  of costs actually  incurred as provided for in Article 1.3.2(a)(i), only costs incurred
                before termination takes effect are reirnbursed  or covered by the grant. Costs relating to contlacts due
                for execution  only after termination are not taken into account arrd are rrot reitnbulsed or coveled  by
                the grant.

                The Agency  may reduce the grant in accordance with Adiclell.25.4 in case of:

                    (a) irnproper termination  of the Agreement by the coordinator within tlre meaning of Article
                        II. I 7. l; or

                    (b) termination of the Agreemerrt by the Agency  on any of the grounds  set out in points (c), (f)
                       and points (g) to  0)  of Article II.l7.3.l  .

                Neither party rnay clairn damages on the grounds  that the other pafty terminated the Agreement.
