Atlel termination, the beneficiaries' obligations continue to apply, in parlicular those under Articles
1.4, 11.6,11.8, II.9, 11.14,11.27 and anv additional provisions on the use ofthe results, as set out in the
Special Conditions.
(a) The coordinatol must submit a request for amendrnent including:
(i) a proposal to reallocate the tasks of the beneficiary or beneficiaries concerned by the
terrnination; arrd
(ii) if ttecessafy, the addition of one ol' rnore new beneficiaries to succeed the beneficiary or
beneficiaries concerned in all their rights and obligations under the Agreement.
lf the Agency terminates the participation of a beneficiary, the coordiuator must submit the request for
anretidment witlrin 60 calendar days frorn the day on which the tenninatiou takes efTect.
ll'the coordinator terminates the participation of a beneficiary, the fequest for amendment must be
included inthe.fbrmulnoti/iccttion of termination referred to in Article 11.17.2.
lf termination takes effect after the end of the implementation period, no request for amendment must
be provided unless the beneficiary concerned is the coordinator. In this case, the request for
antendment must propose a new coordinator.
lf the request tbr amendment is rejected by tlre Agency, the Agreement may be terminated in
accordance with Article ll.l7.3.l (b). The request for amendment may be rejected if it calls into
question the decision awarding the grant or is contrary to the equaltreatment of applicants.
(b) The beneficiary concerned by termination must submit to the coordinator:
(i) a technical repoft; and
(ii) where applicable, a financial statement covering the period frorn the end of the last
reporting period to the date when termination takes effect.
The coordinator must incltrde this inforrnation in the payment request for the nexr repofting period.
Only activities undeftaken before the date when the terminatlon takes effect must be taken into
accottnt. Where the grant takes the fomr of reimbursement of costs actually incurrcd as provided for irr
Article I.3.2(a)(i), only costs incun'ed by the beneficiary concerned before terrnination takes effect are
reimbursed or covered by the grant. Costs relatirrg to contmcts due for execution only after termination
are not reimbursed or covered by the grant.
T'he Agency may reduce the grant in accordance with Anicle 11.25.4. in case of:
(a) impropel tennination of the participation of a beneficialy by the coordinator within the
meaning of Article ll.l7.2 or
(b) terrnination of the participation of a beneficiary by the Agency on any of the grounds set out
in points (c), (0, (g), (h) or(i) of Article tt.17.3.1.
Neither pafty Inay clairn damages on the grounds that the other party terrninated the participation of a
beneficiary.
Atter terrnination, the concerned beneficiary's obligations continue to apply, in particular those under
Articles I.4, 11.6, 11.8, I1.9, ll.l4,ll.21and any additional provisions on the use of the results, as set out
in the Special Conditions.
