have the meanings given to them by Decisiorr 201 l/833/EU.
The above riglrts of use may be further specified in the Special Conditions.
Additional rights of use for the Agency and/ol the Union rna] be provided for in the Special
Conditions.
Tlre beneficiaries must ensure that the Agency and/or the Uniorr have the right to use any pre-cxi,tting
rights included in the results of the action.The pre-existing rights must be used l'or the sanre purposes
atrd under the same conditions as applicable to the rights of use of the results of tl'te action, urrless
specified otherwise in the Special Conditions.
Information abor.rt the copyright owner must be inserted in cases where the rcsult is divulged by the
Union. The copyright information must read: 'O name of tlre copytight owner. All rights

reserved. Licenced to the European Union under conditions'.
lf the beneficiaries grarrt rights of use to tlre Agency and/or the Commission, this does not affect its
confidentiality obligations under Article ll,6 or the beneficiaries' obligations under Article IL2.l.
ARTICLE II.IO - AWARD OF CONTRACTS NECESSARY FOR THE IMPLEIvIENTATION
OF THE ACTION
II.10.1 lf the implementation of the action requires the beneficiaries to pl'ocure goods. works or
services, they may award the contract in accordance witlr their usual purchasing practices
provided that the contracts is awarded to tlre tender offering best value fol rnoney or, as
appropriate, to the tender offering the lowest price, In doing so, they must avoid any conllict
of intcrests.
The beneficiaries must ensure that the Agency, the Commission, the European Court of
Auditors and the European Anti-Fraud Office (OLAF) can exercise their rights undeL Article
II.27 also towards the beneficiaries' contractors.
II.10.2 Beneficiaries that are 'contracting authorities' within the meaning of Dilective 20l4l24lEU2
or 'contracting entities' within the meaning of Directive 20l4125lEUr rnust conrply with the
applicable national public procurement rules.
