AN ADMINISTRATIVE REGULATION IMPLEMENTING A
FAMILY AND JvfEDICAL LEA VE POLICY
AND SUPERSEDING AR-95-1
I. ST TEMENT OFPOU Y
In accordance with the Family and Medical Leave Act, effective August 5, 1993, the City of
Farmington will grant family and medical leave to eligible employees for up to 12 weeks per 12-
month period for any one or more of the following reasons:
A. The birth of a child and in order to care for such child or the placement of a child with the
employee for adoption or foster care (leave for this reason must l)e taken within the 12-
month period following the child's birth or placement with the employee); or
B. In order to care for an immediate family member (spouse, child, or parent) oftl~e employee
if ruch immediate family member has a serious healtb condition; or
C. The mployce's own serious bea llh condition that makes the employee unable to perfonn
the fuL\Otious ofhis.lhcr po~ilion. ·
A. "1\velve Monlli r•erio<l" - means a rolling 12-month period measured backward from !he
date leave is tnken and continuous with each additionnl leave day taken.
B. 11 ~ 11 - does not include i.u1manied domestic partn.ers. If both spouses or both parents
work for the City of Farmington, their total leave· in any 12-mouth period may be limited to
au aggregate of 12 weeks iflhe leave is taken for either the birth or placement for adoption
or foster care of a cmld or to care for a sick parent.
C. "Child" -means a child either under 18 years ofage, or 18 years of age or older who is
incapable of self.care because of a mental or physical disability. An employee's "child" is
one for whom tho employee has actual day-to-day responsibility for care ;md includes a
biological, adopted, foster or step-child.
D. '' erious Health Condilion" - means an illness, injury, impairment, or a physical or mental
co11dition that involves:
1. Inpatient care; or
2. Any period of incapacity requi1ing absence .from work for more than tltree calendar
d~vs AND that involves continuing treatment by a health care provider; or
