                         C.   For part-time employee-5 nnd those who work variable hours, the family and me<lical leave
                               entitlement is ca1ct1Jated on a t2IQ. rata basis.  A weekly average of the hours worke<l over the
                               12 weeks prior to the beginning of the leave should be used for calculating the employee's
                              nmmal wor!Gveek.
                         V.  SUBSTITUTION OF PAID LEAVE TIME

                         A.   An employee may designate to first use accrued paid sick leave, vacation time, or
                              compensatory (comp) time for any part of a family-medical leave taken for any reason.  In
                              the absence of a written designation from the employee, accrued paid sick leave will .first be
                              used, and then any accrued paid vacation time will be used.

                         B.   When an employee has used all accrued paid leave time for a portion of fanrily/medical
                              leave, the employee may req_uest an additional period of unpaid leave to be granted so that
                              the total of paid and unpaid leave provided equals 12 weeks.

                         C.   Any leave taken under the terms of this policy shall run conctnTcntly with any olher
                               applicable leaves that may be allowed under the Personnel Rules for the City of Farmington.

                         VJ.  NOTICE REQUIREMENT

                         A.   An employee is required to give 30 days notice i11 the event of a foreseeable leave.  A
                              "Request for Fam.ily/M~edical Leave'' fonn (attached as Form A) should be complete.d by the
                              employee and returned to the immediate supervisor.  The inunediate supervisor who first
                              receives the employee's Request will promptly notify the Department Head and the
                              Personnel representative of the pending Request for Family/l\1edical Leave.  In unexpeclcd
                              or unforeseeable situations, an employee should provide as mllch notice as is practicable,
                              followed by a completed "Request for Family/Medical Leave" fonn.
                         B.   If an employee fails to give 30 days notice for a foreseeable leave with no reasonable excuse
                              for the delay, the leave will be denied until 30 days after the employee provides notice_
                         Vll 1vffiD1CAL CERTIPICA 'ION

                         A.   For leaves taken because of the employee's or a covered family member's se1ious health
                              condition, ihe employee must submit a completed "Physician or Practitioner Certification"
                              fonn (see Forms B and C) and return the certification to the Personnel Division.  The
                              employee must provide the properly completed medical certification within 15 days after
                              requested, or as soon as is reasonably possible.

                         D.   The City ofFannington may require a second or lhinl opinion (at its own expense), periodic
                              reports on the employee's status and intent to return lo work, and a fitness-for-duty re?orl to
                              return to work.
