The Importance of Maqasid Shariah

2 in State Governance

Adopting the values of Maqasid Shariah in state governance is important. The impact of adopting
such values can be observed in the following areas:

i. Providing a degree of flexibility in state governance consistent with the maslahah in
question

Governing the country based on Maqasid Shariah will show that the shariah of Islam is
flexible, consistent with the maslahah (benefits) in question. This is due to the fact that
administration affairs are not restricted to the divine revelations, i.e. the Quran and Sunnah
but are open to the ijtihad (independence reasoning) of the ruler so long as it does not
contradict the nusus (clear and defined meaning) of shariah (Quran and Sunnah). Thus,
understanding Maqasid Shariah and practicing it in state governance will reflect the beauty
of Islam and promote it as a religion that is suitable for all times.

ii. Creating far-sighted actions that serve public and state interests

Guided by the rules of Maqasid Shariah, the ruler will remain focused and far-sighted in
evaluating and considering the extent to which an action is beneficial or harmful. Based on
such a consideration, the actions of the government will always bring about benefits and
advantages although on the surface and from a short-sighted perspective they may not seem
beneficial.
