Homeowners or their guests, including, but not limited to, damage caused by falling
trees, electrical power surges, or gas leakage from the line between the mobilehome
and the meter or within the mobilehome itself.
This notice shall be considered full notification that community property, facilities, and
equipment are used at the risk of the user.
17.2 Homeowner agrees to indemnify, hold harmless and pay attorney fees of Owner from
and against any and all claims arising from any act, omission or negligence of
Homeowner or Homeowner's contractors, licensees, agents, servants, invitees, or
employees, or arising from any acts, injury or damage whatsoever caused to any
person or property occurring in, on, or about the Community and from any and all costs,
expenses and liabilities incurred in or in connection with any such claim or proceeding.
17.3 No acts or activities shall be committed which would place the management or owner of
the community in violation of any federal, state, local or other governmental authorities
law, ordinance or other regulations. Any such violation is grounds for injunctive relief
under section 798.88 of the Mobilehome Residency Law.
17.4 Homeowners using areas in, adjacent or in close proximity to, the community assume
the risk of natural hazards such as rivers, creeks, drainage channels, lakes, trees,
roadways, open space areas, etc.
18 BUSINESS SOLICITATION
18.1 The community is intended for Homeowner use only; displaying business signs is
prohibited.
18.2 We recognize that home office businesses occur; such business shall not retain on
premise employees, and shall not generate customer traffic, or business deliveries.
18.3 Homeowners shall not solicit or sell trailers, mobilehomes (except their own) or articles
of any description without the prior written approval of the management. No individual
"auction", "moving", or "garage" sales are permitted. Estate sales shall be permitted up
to twice per year per space upon prior written approval of management.
19 SPECIAL RULES
19.1 Other community rules of conduct concerning the use of Community facilities are
posted throughout the community and by this reference are incorporated herein as
though set forth in full. Homeowners must read and follow the posted rules. Rules
relating to recreational facilities may be amended by management upon 60-day written
notice.
19.2 Complaints and requests for approvals, repairs or service, etc. from Homeowner to
Owner must be in writing on an approved form and signed.
19.3 The manager's office will be closed on all weekends. Community business will be
conducted only during posted business hours. In an emergency, after business hours,
the manager may be contacted at his mobile home in the Community or by telephoning
the emergency number posted at the office.
20 RIGHT OF ENTRY AND INSPECTION
20.1 The management shall have the right, pursuant to Civil Code Section 798.26, to enter
upon the land which a mobilehome is situated for maintenance of utilities, for inspection
and maintenance of the premises in accordance with these Rules and Regulations,
and/or for enforcement of the Rules & Regulations and for the protection of the
community, and may enter a mobilehome in case of emergency or upon abandonment.
