new drywall was installed. In this way it was presented as being a
        new firm. After that Kazova was closed. NES TRIKO also closed,
        on the same date…

            After the workers started resistance the drywall wall was torn
        down and a brick one replaced it.  The workers tried to get their

        hands on the machines by pursuing sequestration. However, the
        person who claimed to be the owner of NES TRIKO lodged an
        objection to the sequestration. In the objection by Abdulkadir
        Nergis, it was stated that the firm closed at the start of February
        2013 and the machine fixtures, weaving machines and other textile
        machines were sold to MIDYATLI LTD. Nes Triko had received
        these machines from Kazova A.S.  in which the Somuncu families
        were partners and owners, and had sold them to the firm called
        Midyatli Ltd. It appeared there was no problem. Everything was

        in accordance with the law. But the problem lay with who was a
        partner of Midyatli Ltd. Midyatli Ltd.’s partnership was with none
        other than the SOMUNCU FAMILY. So the SOMUNCU FAM-
        ILY which was the owner of Kazova was ALSO THE OWNER OF
        THE MIDYATLI COMPANY. And what Abdulkadir Nergis was
        doing was nothing other than transferring machines between two
        companies, both owned by the same family.

            Everyone can understand this as collusion, a sham sale. But

        the laws do not comprehend this, nor do judges.

            On 12 November the Kazova worker went to court concern-
        ing the objection to their sequestration. The court implemented
        the law and cancelled the Kazova workers’ sequestration. The ob-
        jection by the owner of the shell company was found to be valid.
        The lawyer of the shell company was also present at the hearing.
