Supreme Court Backs Centre On Scrapping Of
Jammu & Kashmir Special Status
The Supreme Court delivered a landmark judgment
on Monday, declaring Article 370 of the
Constitution, which granted special status to the
former state of Jammu and Kashmir, as a
"temporary provision." In a unanimous decision, the
court upheld the Center's action on August 5, 2019,
to abrogate the provisions of Article 370.
Additionally, the court directed the expeditious
restoration of statehood for Jammu and Kashmir
and mandated the holding of assembly elections by
September 30, 2024.
In 2019, the Central government revoked the
special status, leading to the bifurcation of the state
into two Union Territories – Jammu and Kashmir,
and Ladakh.
The judgment, delivered by a five-judge Constitution bench led by Chief Justice of India DY Chandrachud,
concludes a series of petitions challenging the government's decision made four years ago. Following a
comprehensive 16-day hearing, the Supreme Court reserved its judgment on September 5.
The petitioners contended that the unilateral scrapping of Article 370 by the Center was impermissible,
citing that the powers of the Constituent Assembly had been transferred to the Jammu and Kashmir
legislature after its dissolution in 1957.
Donald Tusk appointed Polish PM
Poland’s parliament backed Donald Tusk to become prime
minister on Monday, ending eight years of nationalist rule
and putting the country on track for a thawing of relations
with the European Union.
Poland has seen tens of billions of euros of European
Union funds frozen due to a dispute with Brussels over
democratic standards, but Tusk, a former European
Council president, has vowed to mend relations and
unblock the cash.
Tusk got the votes of 248 lawmakers while 201 were
against.
