DIVORCE PRACTICE IN ISLAM
{Q 4:34-35},
Divorce (Talaq), is the last option in ending marriage conflicts. Divorce should not
be the starting point of solution. Allah (SAW) guides husband and wife to be
committed to each other and live according to the Islamic teaching. Therefore,
divorce should be the last resort.
According to Islam, divorce is divided into two main traditional categories, (I) the
divorce issued by the husband (Talaq) also known as repudiation and, (II) the one
requested by the wife (Khula). Even though divorce is legal, it should not used as a
weapon of dissolving marriages. Seeking experts on marriage counselling and
mentoring can be used to avoid separation. The marriage experts can listen to the
divorce case and complaints from both sides at a time, and lastly give the two
couples an advice on how to carry on with their married life. The following
chapters shall give discussions on how a separation is achieved through Khula
divorce, steps that can be applied to save marriages from breaking, steps on how
Khula divorce can be achieved.
KHULA DIVORCE
Good marriage relationship is only achieved in the atmosphere of mutual love,
marital fulfilment and respect, accepting, appreciating and understanding each other
in all circumstances. However, in the solemnization of such marriage, things can go
wrong in a situation which is no longer bearable. At this point the wife can protect
her rights by using Islamic approach to dissolve the marriage. One of the Islamic
approaches is through Khula divorce.
