When the husband has failed to full fill his marital duties such as, being incapable
to sleep with her wife due to long-time illness, domicile or paralyzed after involved
in an accident. When the husband becomes adulterous and refuses to change and
rebuild their relationship the wife has the right seek for Khula divorce.
MARRIAGE DISSOLUTION BY KHULA DIVORCE
As already mentioned from the previous chapters, Muslim men and women have
been taught the proper processes of resolving conflicts in marriages. Divorce should
always be the last weapon. If married life is filled with love, mercy, compassion,
and tranquillity because it is a blessing from Allah (SAW)
According to the Islamic ways of living (fiqh), each couple has his or her active
rights and duties over each other which should be undertaken to enable harmonious
relationship. When things change, and the situations turn out to be dangerous and
may likely lead to psychological torture, distress, and suffering of the wife. At this
point divorce can save the situation. Separation practice should be conducted in a
peacefully and morally acceptable way as discussed in the Holy Quran.
Important steps to consider before divorce
Spouses should be encouraged to pursue all possible solutions to bring back their
relationship. But in the event where the marriage environment has changed upside
down, especially for early years of most marriages there shall be no other way
rather than following the Islamic Shariah to dissolve marriage. The following
prescribed procedures or steps are to be followed as per the Islamic Shariah before
dissolving any Islamic marriage.
