Abstract

Deviating a criminal case is one measure to remove offenders from criminal proceedings

that will lead to punishment by giving the offender an opportunity to correct, heal, rehabilitate
and improve themselves.If the offender complies with the rules and conditions as specified,

the offender will not be punished. Thailand has adopted measures to divert cases in many

laws. But there are still a lot of problems and obstacles, therefore, the objectives of the laws

are not achieved. A question has been raised whether imprisonment is the most effective

punishment for drug and other criminal cases.The author examined the measures applied by
the Netherlands. The measures emphasize on resolving rehabilitating offenders and using

alternative measures instead of using imprisonment. In Thailand case diversion measures are

adopted by the Act for the Establishment of and Procedure for Juvenile and Family Court

B.E.2010. This research paper proposes that the criminal diversion measures should be applied

on drug and other criminal cases, a practice which will reduce the number of those court

cases.

ในปัจจุบัน สภาพปัญหายาเสพติดและปัญหาอาชญากรรมในประเทศไทยทวีความรุนแรงเพมมากขึ้น

ส่งผลกระทบต่อสังคมเป็นวงกว้าง ท าให้ภาครัฐต้องทุ่มเทงบประมาณจ านวนมากในการจับกุมและปราบปราม

บูรณาการแล้ว ประเทศไทยคงประสบปัญหานักโทษล้นเรือนจ า เมื่อบุคคลเหล่านั้นพนโทษออกจากเรือนจ า
กลับปรากฏว่าสังคมโดยทั่วไปไม่ค่อยให้การยอมรับและมักไม่ให้โอกาสบุคคลเหล่านั้น ท าให้บุคคลเหล่านั้นหา

งานท าไม่ได้ และกลับไปก่อปัญหาอาชญากรรมอนๆ จนท าให้ต้องกลับเข้าไปอยู่ในเรือนจ าเช่นเดิม วนเวียนอยู่
