Abstract
In accordance with international principles, a person is guaranteed and
protects his or her rights in various fields. When an act affects the rights of a person, that
person is entitled to compensation. or substitute especially when criminal acts occur. A
person whose rights have been violated, who are considered victims of such
infringement, shall be compensated by the State. which is responsible for the safety and
security of the rights of the people including the right to receive remedies from the
victims The rights of the victim or victim (Victim's Right) in a criminal case should
therefore be protected to genuine reparation.
At present, although there are some laws to protect and certify the rights of
victims But there are still a lot of casualties. incompletely healed or not thoroughly
There are legal problems that should be studied as follows: (1) at the investigative level
and in the public prosecutor's level; Victims are unaware of the law or their rights. thus
there is no opportunity to object to the provisional release in the stage of prosecution
or detention; (2) at the trial of the court; If it is a criminal case in which the defendant
pleads guilty, it is a case in the jurisdiction of the district court. The court can have a
judgment immediately on the date the plaintiff filed the plaint. Causing the victims to
lose the right to file a claim for compensation under Section 44/1 and (3) after the court
sentenced the defendant to pay compensation to the injured person. Most of the
defendants in criminal cases are poor, do not have property to pay for the victims, or
the defendants may be sentenced to imprisonment resulting in inability to pay the
victims according to the court's judgment. and the execution of the victim, the injured
person has to do it alone and must pay the expenses and execution costs thereby
redressing the civil damages of the injured person therefore cannot truly achieve the
objectives of the law.
