Chayei Adam - K’lal 139 - The Laws of Rosh Hashana Night & Rosh Hashana Tefilos

                                                                                                    4
to daven the entire tefilah on Rosh Hashana and Yom Kippur, while bowing.
However, they must straighten up in order to bow at the proper places. Therefore,
one should bow when he says ‘boruch’ and then straighten up when saying
                        5
‘Hashem’. Then, he can bow until before the end of the beracha, at which point
he should straighten up. Then, when saying ‘boruch’ he should bow and
straighten when saying ‘Hashem’ and then remain straight until he has said a few
words of the second beracha, meaning at least until ‘You are mighty forever,
Hashem’ while standing. [This is because] it is forbidden to bow at the beginning
                                                                                         6
                                                                                                    7
or end of any beracha, except where Chazal mandated that we should. Similarly,

                                                       םדו רשב
this means that one who said שודקה לאה must ruling out of hand. See however Igros Moshe
repeat shemoneh esrei, and this is in fact the (O.C. 1:170) who maintains that certainly if one
ruling of Shulchan Aruch. Even if he didn’t davened a weekday shemoneh esrei, he must
finish shemoneh esrei, he must begin from the daven again. However, although yom tov
beginning because the first three berachos are certainly begins at nightfall, Hashem does not
considered a single unit. If he corrected manifest Himself as King until He sits in
himself immediately before beginning the judgment in the morning, and therefore
                                ו
next beracha, he does not need to repeat it. omitting HaMelech HaKadosh does not
                                                           invalidate his tefilah.
In K’lal 24, the Chayei Adam cites the opinion
of Rav Avli Pasveller that one who forgot
HaMelech HaKadosh on Rosh Hashana night, HaMelech HaMishpat - The gemara
need not repeat shemoneh esrei. He reasons (Berachos 12b) concludes that although during
that as one who omits ‘yaaleh v’yavo’ in the year one should say ‘melech oheiv tzedaka
maariv on rosh chodesh does not repeat it u’mishpat’ (the King who loves charity and
because beis din never sanctified the new justice), during the ten days between Rosh
month at night, so too, the night of Rosh Hashana and Yom Kippur, one should say
Hashana could not yet have been established ‘HaMelech HaMishpat’ (the king of justice).
by beis din and therefore does not need to be Accordingly, the halacha should be no
repeated. The Shaar Hatziyun (582:4) however different than one who says ha’keil ha’kadosh
questions how this could be since it is a instead of ha’melech ha’kadosh and that he
blatant contradiction to the yom tov tefilah. He should have to repeat shemoneh esrei. This is
suggests perhaps that it is only true if he in fact the ruling of most rishonim (Tosfos,
concludes with a weekday shemoneh esrei and Rosh, Tur) and decided as halacha by Shulchan
it is not likely that he would recommed doing Aruch. However, the Tur reports that some
so. Therefore, the Mishna Berura rejects this places had the custom to say ‘Keil oheiv
