                                    35 May 2025 Abbott UK Company Car Handbook33.14 WHAT RIGHTS DO DRIVERS HAVE IN RELATION TO THE PERSONAL DATA COLLECTED BY THE TELEMATICS DEVICE?Abbott recognises that all Drivers have rights concerning how their personal data is handled (including sensitive personal data). These rights are set out in the General Data Protection Regulation 2016/679 (known as the %u201cGDPR%u201d) and include:%u2022 the right to request from Abbott UK at any time, access to or rectification of their personal data;%u2022 the right to have their personal data erased in certain circumstances;%u2022 the right to restrict Abbott UK%u2019s processing of their personal data in certain circumstances;%u2022 the right to object to Abbott UK%u2019s processing of their personal data in certain circumstances; and%u2022 the right to have Abbott UK transfer their personal data to another controller in certain circumstances. Where Abbott UK processes a Driver%u2019s personal data based on the Driver%u2019s consent, the Driver has the right to withdraw that consent at any time. Abbott UK is not relying on Driver%u2019s consent to process any personal data set out in this section 6. Drivers have the right to complain to a supervisory authority. In the UK, this is the InformationCommissioner%u2019s Office (ICO)34 OBLIGATIONS OF DRIVERSDrivers must inform FMG as soon as possible if there are any issues with the telematics device or they believe the device may be causing any vehicle electrical errors. Where the device is faulty it is the driver%u2019s responsibility to manually track business and personal mileage. A manual mileage tracker can be obtained from the Payroll department (ukpayroll@abbott.com) for this purpose and any mileage should be processed through the Concur expense system. Further guidance is available from the Payroll department if required.Drivers must ensure that all other drivers of their vehicle are informed that a telematics device is fitted to the vehicle and advise them of the contents of Section 33 of this handbook.Drivers must keep the data captured by the telematics device to which they have access to as private and confidential and must not use, process, store or disclose any such data captured other than for the purposes of:%u2022 Identifying ways in which their own driver behaviour may be modified or improved;%u2022 Identifying training needs in relation to their own driver behaviour;%u2022 To determine private /business journeys and denote accordingly in the online portal by the 9th of each month %u2022 Preparing any relevant information required in relation to an allegation or claim made against them arising from their own driver behaviour, accident or use of the vehicle.Drivers are not authorised to use the data captured by the telematics device to which they have access for the purposes of monitoring the driver behaviour (or other information) relating to another driver or associated person.Abbott accepts no responsibility for any unauthorised usage by a driver of the data captured by telematics device to which they have access.Drivers understand that it is set out in the employee handbook that drivers who receive company cars must have the telematics device installed.Any failure to comply with the terms of this policy, may result in disciplinary action being taken up to and including dismissal without notice or payment in lieu of notice on the grounds of gross misconduct.
