9.0 Cell Phone Use & Telephone Safety Guidelines

Incoming and outgoing personal telephone calls during work hours should be confined to those that are absolutely neces-
sary, should be kept to a minimum and must not interfere with work. Improper personal telephone use during working
hours may result in disciplinary action up to and including termination.

Hercules is committed to promoting highway safety by encouraging the safe use of cellular telephones by its employees
while they are on company business. To this end Hercules requires that employees adhere to the following cell phone
         safety guidelines:
                1. You may not use a cell phone while operating a vehicle unless it is equipped with a hands-free device. You
may never use a cell phone, with or without a hands-free device, when road conditions are poor, traffic
is heavy or your phone conversation is complex.

                2. You may not use a cell phone while operating any machinery whose safe operation requires your full atten-
                       tion.

Hercules assumes no responsibility or liability for any incidents or accidents that take place due to any employee’s im-
proper use of a cell phone.

10.0 Personal Telephone Calls, Mail, and Property

Please keep personal phone calls to a minimum. They also must not interfere with your work. You are permitted to
make limited local area calls on company telephones for essential personal business during lunch or break periods only.
Emergency calls regarding illness or injury to family members, changed family plans, or calls for similar reasons may be
made at any time. Incoming urgent calls will be directed to you. Long distance personal calls are prohibited unless there
is an emergency and your Supervisor is notified.

Please do not use Hercules as your personal mailing address, and do not use company postage for personal mail. Alt-
hough the amount may seem small, it is still considered theft and can be grounds for disciplinary action, up to and in-
         cluding termination.
Personal equipment or vehicles left on Hercules property are left at the employee’s own risk. Hercules will not assume
any responsibility for loss or damage to personal property of any employee.

         11.0 Bulletin Boards

Each property has an established location where proper posting of Federal/State and local laws are housed for your infor-
         mation.
