6.3.3. All measurements shall be made as per the specifications in Clause 1 to 5

above. All arrangements for measurement shall be provided by the BUYER
free of cost as per KUMAR’s specification.

6.4.4 All measurements shall be made only during the steady state condition of

the plant and only reading recorded during the steady state condition will
be considered for evaluating the plant performance.

In case of brief interruption (not exceeding 4 hours per 24 hours) In the
operation of the plant, necessary correction will be made for the plant

down time as well as for the starting and unsteady operation.

In case of interruption totaling more than 8 hours in 72 hours as well as

in case of frequent interruptions within a shift, the performance trial will

be repeated.

6.4.5 If the performance trail has to be repeated several times and performance

evaluation could not carry out within a period of 30 days for reasons
attributable to buyer, KUMAR shall be absolved of giving the performance

trial.

6.4.6 The measurement is subject to accuracy of instruments used. All

performance guarantees will be subject to a variation of ±5%.

6.4.7 Any variation beyond ±5% in the performance of any one of the
parameters will be offset against the variation in other parameters.

A.5.1 If after the completion of performance trials, the plant performance
of process guarantees or utility guarantees are not met and if the

plant has to be modified as per this Agreement, performance trial

will be repeated after completion of such modifications.
