B. PERISTILAHAN
Sedari awal, istilah IPR sendiri tampaknya telah diliputi dua macam
persoalan. Pertama, kehadiran kata "rights". Kedua, adanya istilah
“intellectual property law” yang akhirnya juga memerlukan klarifikasi.
Beberapa ahli berpandangan, kehadiran kata “rights” dalam Intellec-
tual Property Rights dianggap berlebihan. Sebab, seperti dijelaskan
Phillips dan Firth, kata property yang berasal dari bahasa Latin, yaitu
proprius sudah berarti “kepemilikan sesuatu”. Dengan demikian,

Dalam soal peristilahan ini, penjelasan Sherwood tampaknya
lebih mampu memberi gambaran mengenai problem tadi.
The term ‘intellectual property’ contains both the concept of pri-
vate creativity and the concept of public protection for the result
of that creativity. Said another way, invention and creative ex-
pression plus protection equals ‘intellectual property’. Property, of
course, is a relative concept in virtually all legal systems.
To help clarify the concept of intellectual property, it can be noted
that the term ‘intellectual property rights’ is a redundant expression.
The concept of rights is, of course, implicit in any understanding of
property. That the redundant term is in common usage, however,
seems to reflect the lack of any other convenient collective term
for those ideas, inventions and creative expressions which, when
accorded public protection, give rise to the concept of intellectual
