it can bo dealt with according to law; pnrislmblo articles being disposed of
as tlio Court may consider best in the interests of tho ostato.
(4) All oxponscs incurred on bohalf of tho Court in so doing shall bo tho
first clmrgo on tho proporty of tho' deceased, and the Court shall, by sale of
part of that proporty, or othorwiso, provido for tho discharge of those
oxponscs.
(5) VVhon a British subject or foreigner dies within tho jurisdiction of
tho Court ns prescribed by this Order intestate, his property, or so much
thereof ns is within thoso limits, shall, until administration is granted, vest in
the Political Agent.
40. If a porson to whom this Order applies bo named executor in a
will, and to tho establishment, of whose titlo as such it is necessary to obtain
probate of that will, tako possession of and ndministors, or otherwise deals
with, any part of tho property of tho deceased, and docs not obtain probnlo
within ono month after tho death or after tho tormination of any proceeding
respecting probate or administration, ho shall*bo liable to pay double tho
amount of any fees chargeable on obtaining probato, and ho shall also bo
liable to a lino which may oxtond to 1,000 rupees.
41. If any person, to whom this Order applies, other than tho person
named executor, or the administrator, or a porson entitled to represent tho
deceased without obtaining probato or letters of administration, or an officer
of tho Court, takes possession of and administers, or otherwise deals with, any
part of tho proporty of tho deceased, ho shall, ns soon ns practicable, notify
tho fact and the circumstances to tho District Court, and shall furnish to
tho Court all such information as the Court roquires, and shall conform to any
direction of the Court in relation to tho custody, disposal, or transmission of tho
property or tho proceeds thereof, and, in caso of any contravention of this
Article, ho shall bo punished with lino, which may extend to 1,000 rupees.
42.—(1) When tho peculiar circumstances of the case appear to tho District
Court so to require, for reasons recorded in its proceedings, tho Court may, il
it thinks fit, of its own motion or otherwise, grant letters of administration to an
officer of tho Court.
(2) Tho officer so appointed shall act under the direction of tho Court,
and shall bo indemnified thereby.
(3) Ho shall publish such notices, if any, as tho Court thinks (it, in
Bahrein, the Persian Coast and Islands, Bombay, tho United Kingdom, and
clsowhcro.
(4) Tho Court shall roquiro and compol him to file, in tho proper offico ol
the Court, his accounts of his administration at intervals not exceeding threo
months, and shall forthwith examine them and report thereon to tho Chief
Court.
