           (5) Tho accounts shall he audited under tho direction of the District
        Court.
           ((i) All oxpensos incurred on   behalf of tho Court in execution of this Articlo
        shall ho the first clmrgo on tho estate of tho doceascd as dealt with in accordance)
        with tho provisions of this Onlor; and tho Court shall, by tho sale of that
        cstato or othorwiso, provido for the discharge of those oxponscs.

           43. In cases whore parties aro Mahonnnedans tho District Court may rofor
        any question, concerning prolmto of wills or administration of property of
        deceased persons to whom this Order applied, to a Kazi for settlement under tho
        gcnoral supervision of tho Court.

                      Part Y.—Bahrein Subjects and Tribunals.
                                    (a) Criminal.
           44.—(1) When a Bahrein subject dcsiros to institute a complaint against
        n porson to whom this Order applies, or a person to whom this Order applies
        dcsiros to institute a complaint against a Bahrein subject, tho Political Agent
        shall ontortain tho same, aud may—
           («) With tho coucurrouco of tho Shoikh of Bahrein, himself hear and
                 dotormino it in his District Court, or
           (&) Sond it to tho Joint Court, or
           (c) If tho defendant is a Mahommedan, refer it to a Knzi for decision,
                 sending a ropresontativo of tho Agency to rocord briefly tho
                 proceedings. Such decision, when ondoTsed by tho Political Agont,
                 shall for all purposes bo considered as if it wore that of tho District
                 Court.
           (2) Nothing in this Articlo shall prevent tho Political Resident from
        exercising tho rovisory powers possessed by him under Articlo 4 of tho
        Convention with Bahrein, datod tho 31st May, 13(51.

                                     (b) Civil.
           45.—(I) When a Bahrein subject desires to bring a suit against a porson
        to whom this Order applies, or a person to whom this Order applies desires
        to bring a suit against a Bahrein subject, tho Political Agent shall admit tho
        complaint, and
            («) With tho concurrence of tho Sheikh of Bahrein, may hear and
                 detormino tho suit in his District Court, or
            yb) May hear and detormino it in a Joint Court, or
            (c) May refer it to tho Majlis ol-Urf for decision, or
            (</) In cases between pcarling-mustors and divors, may refer it to tho
                 3alifah Court, or
            (c) With tho consent of tho several parties, may rofor tho caso to one or
                 moro Arbitrators for sottlomcnt.
