a portion of a military leave of absence for annual training duty or emergency services
not to exceed one month.
Paid Time Off accrues each pay period (except new employees who are not eligible to
accrue Paid Time Off until after a 90 day waiting period). The length of eligible service is
calculated on a service year basis. An employee’s service year PTO eligibility will not be
impacted if they are on military leave.
A copy of the orders to serve must be turned in to the employee’s supervisor. Military
leaves beyond 10 days will be considered a leave of absence for Military service.
Notification
Employees called to active/training duty or to Reserve or National Guard training, or who
volunteer for the same, should submit copies of his/her military orders to their supervisor
as soon as possible so that production schedules and vacation schedules may be arranged
consistent with operating needs.
Pay During Leave
Employees called for annual or special Reserve or National Guard duty training during their
regularly scheduled work days may receive the difference between their regular pay and
military service pay, up to a maximum of ten (10) days per year. To be eligible for this
military leave pay, an employee must be a full-time regular employee who has completed
three (3) months of employment, who is actively employed and on the payroll up to the
time he/she reports for duty, and who returns to Jones-Hamilton Co. after completion of
such duty.
Benefits During Leave and Return to Employment
Federal and state laws prescribe the employee benefits to which employees are entitled
while in military service and their rights to return to employment upon completion of
military service. Because these laws change from time to time, their terms are not set out
here. Jones-Hamilton Co. will comply with applicable laws regarding these matters.
JURY/WITNESS LEAVE
Upon notice, summons, or subpoena to sit on a jury or serve as a witness, an employee
must notify his/her supervisor and provide a copy of such notice, summons, or subpoena,
the next working day after receipt thereof to be given time off from work to perform this
service.
Eligibility and Pay
Employees are eligible for paid jury duty/witness leave after completion of their 90-day
trial period. For each day of jury duty or witness leave up to a maximum of 5 days, an
employee will receive his/her regular straight time compensation less any amount received
for service from the Court. Any employee, who must take more than 5 days off work to
serve on a jury or as a witness, may use PTO that is otherwise available to that employee.
If 2 or more hours of work time remain after any day of jury selection or jury duty or
witness service, the employee will be expected to return to work for the remainder of
his/her work schedule.
