POLICY 102
CLASSIFICATIONS
The following terms will be used to describe the classification of the employees and their
employment status:
Exempt Employee is exempt from the provisions of the Fair Labor Standards Act (“FLSA”) or
similar state laws and is not entitled to overtime payments.
Non-Exempt Employee is generally subject to the minimum wage and overtime provisions of the
FLSA or similar state laws.
Full-Time Employee is an individual who is considered as working an assigned standard
workweek of 30 hours or more and is hired for an indefinite period. A full-time employee may be
classified as either exempt or non-exempt.
Part-Time Employee is an individual who works between 24 to 29 hours a week and is hired for
an indefinite period. A part-time employee may be classified as either exempt or non-exempt.
Temporary Employee is generally an individual who is hired for a specific length of time. A
temporary employee may be classified as either exempt or non-exempt and will not be eligible for
benefits.
Commission Based Sales Employee is an employee who is paid strictly on commission and is
governed by the sales agreement and incentive compensation plan(s) applicable to such employee.
Immediate Family Member means an employee’s spouse, child, brother, sister, parent,
grandparent, grandchild, stepchild, stepbrother, stepsister, stepparent, aunt, uncle, niece, nephew,
or any in-laws of the same.
All employees, regardless of classification or exempt status, are considered to be employed “at-
will” and may quit or be terminated at any time, with or without notice, for any reason.
Any employee having a question as to his/her status under the FLSA, similar state law, or
employment classification, should contact his/her supervisor/manager or the People Operations
Department.
