During a period of FMLA leave, the employee will be retained on Hercules’ health plan on the same basis as coverage
would have been provided if the employee had been continuously employed during the FMLA leave period. To contin-
ue health coverage during the FMLA period, the employee must continue to make any contributions as dictated in the
FMLA paperwork provided by the HR Department that he/she made to the plan before taking leave. Failure of the em-
ployee to pay his/her share of the premium may result in a loss of coverage.
While on unpaid leave, no employee will accrue seniority or employee benefits that would have accrued during the peri-
od of the FMLA leave.
An employee will not be subject to any retaliation or adverse action simply because the employee has chosen to utilize
rights made available under the FMLA. Hercules will not interfere with, restrain or deny the exercise of any right pro-
vided under the FMLA.
The U.S. Department of Labor is authorized to investigate and resolve complaints or violation and any eligible employee
may bring a civil action against an employer for violations. The FMLA does not affect any federal or state law prohibit-
ing discrimination, nor does it supersede any state or local law or collective bargaining agreement that provides greater
family or medical leave rights.
