Beers with our Founding Fathers
Section One. Creates Congress, the bi-cameral legislative
branch of the Senate and House of Representatives. All
legislative powers are vested in Congress.
Section Two. Defines the House of Representatives: how
many representatives, how elected and the terms of office,
requirements to hold office, how to fill vacancies and sole
authority to impeach. The calculations of taxes from the
states and number of representatives. As with the former
‘Articles of Confederation’, this was based on the population
of free persons, excluded native Indians, and counted all
others as three-fifths. As previously noted in this work, the
south argued that counting unfree persons was unfair due
to the large population of slaves and only free persons
should be counted for the purposes of taxation and related
representation. This argument had nothing to do with
whether slaves were inhabitants, humans, equal or lesser –
it was a financial argument; right or wrong. Slaves were
owned property, and a large population of the south.
Therefore, slaves would not be providing any taxable means
for the states.
It should be noted that this section was amended.
Section Three. Defines the Senate: how many senators,
how elected and the terms of office, requirements to hold
office, how to fill vacancies and sole authority to try
impeachments as defined. This also provides that the Vice
President is the President of the Senate, but may only vote if
there is a tie.
